DISCLAIMER AND LIMITATIONS OF LIABILITY AS TO SIMPLEMICRO.COM WEB SITES
PLEASE READ THESE TERMS AND CONDITIONS OF SALE VERY CAREFULLY.
THE TERMS AND CONDITIONS OF SALE ARE LIMITED TO THOSE CONTAINED HEREIN. ANY ADDITIONAL OR DIFFERENT TERMS IN ANY FORMS DELIVERED BY CUSTOMER ARE HEREBY DEEMED TO BE MATERIAL ALTERATIONS AND NOTICE OF OBJECTION TO THEM AND REJECTION OF THEM IS HEREBY GIVEN.
BY ACCEPTING DELIVERY OF THE PRODUCTS AND SERVICES DESCRIBED IN SIMPLEMICRO.COM'S INVOICE IN THE WEBSITE OR OTHER SIMPLEMICRO.COM DOCUMENTATION, CUSTOMER AGREES TO BE BOUND BY AND ACCEPTS THESE TERMS AND CONDITIONS OF SALE UNLESS CUSTOMER AND SIMPLEMICRO.COM / BOSS SYSTEMS USA, INC. HAVE SIGNED A SEPARATE AGREEMENT, IN WHICH CASE THE SEPARATE AGREEMENT WILL GOVERN.

THE Boss Systems USA / SimpleMicro.com WEB SITES AND THE MATERIALS THEREIN ARE PROVIDED "AS IS". Customer understands that SIMPLEMICRO.COM is not the manufacturer of the products purchased by Customer hereunder and the only warranties offered are those of the manufacturer, not SIMPLEMICRO.COM. Most of SIMPLEMICRO.COM's products are guaranteed against defects for 6 months from the date of the invoice. In purchasing the products, Customer is relying on the manufacturer's specifications only and is not relying on any statements, specifications, photographs or other illustrations representing the products that may be provided by SIMPLEMICRO.COM or its affiliates. In connection with services, neither affiliates of SIMPLEMICRO.COM nor third party service providers are agents of SIMPLEMICRO.COM and SIMPLEMICRO.COM has no obligation or liability arising from any services performed by or any warranty, if any, made by, such service providers. BOSS SYSTEMS USA, INC. MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO THE SIMPLEMICRO.COM SITES, THEIR OPERATION, CONTENTS, INFORMATION, MATERIALS. SIMPLEMICRO.COM. EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO THE SITES OR THEIR USE, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. YOU AGREE THAT SIMPLEMICRO.COM, ITS DIRECTORS, OFFICERS, EMPLOYEES OR OTHER REPRESENTATIVES SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM THE OPERATION, CONTENT OR USE OF THE SIMPLEMICRO.COM SITES. YOU AGREE THAT THIS LIMITATION OF LIABILITY IS COMPREHENSIVE AND APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, COMPENSATORY, SPECIAL, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES.
SIMPLEMICRO.COM will not be responsible for any delays in delivery which result from any circumstances beyond its control, including without limitation, product unavailability, carrier delays, delays due to fire, severe weather conditions, failure of power, labor problems, acts of war, terrorism, general insurrection, acts of God or acts of any government or agency. Any shipping dates provided by SIMPLEMICRO.COM are estimates only. For all prices and products, we reserve the right to make adjustments due to errors, changing market conditions, product discontinuation or typographical errors in advertisements. SIMPLEMICRO is not responsible for manufacturer price changes, which may occur at any time without notice. For all orders shipped internationally (outside the continental USA), the customer is responsible for all local duties, taxes and other applicable fees.
Please retain all packing material, documentation, cables, software and other accessories should the product require service or be returned.
SIMPLEMICRO warrants that product(s) is/are free from defective material and workmanship and, subject to condition set forth herein, agree to repair or replacement in accordance with manufacturer's warranties from the date of original retail purchase without charge to parts and/or labor. All our products sold are covered under our 6 Month Guarantee against Defects, unless otherwise specified. If the warranty period is not written on the product details page of that particular item, then it is 6 Months warranty from the date of the invoice. Defective items should be shipped back to us after obtaining a "Return Authorization Number (RMA)" from us. You can fill out the RMA form on our site to obtain an RMA number. You are responsible for shipping and insurance of the defective item to our location. We will ship back the replacement/repaired unit back to you at our expense. All warranties are limited to the original purchaser and is not transferable.
Canceling an Order
An order may be cancelled only if that item is out of stock. We reserve the right to cancel a sale or to issue an RMA number for merchandise that is advertised in error, is unexpectedly out of stock or was shipped in error. Any order placed if in stock will be shipped immediately and cannot be cancelled once shipped.
Billing Information and Fraud Prevention
We accept all major credit cards including Visa, MasterCard, American Express and Debit Cards. There is no surcharge for using your credit card. Your credit card will be charged upon shipment of the order. Please provide us with your correct billing and shipping details, it is a violation of the law to place orders under a false name or unauthorized credit card. Fraudulent ordering will be prosecuted to the fullest extent of the law. Your credit card will be charged under our website name SimpleMicro.com. If your shipping address is different from your billing address, this address must be listed on your credit card account as an alternate address for shipping purposes only. You can contact your credit card company by calling the 1-800 numbers on the back of your credit card.

Upon receipt of the money order or cashiers check your order will be shipped. Personal checks will not be accepted for any purchases.

Return Policies

Before returning any product, you must obtain a Return Merchandise Authorization (RMA) number by emailing a completed RMA Request Form to service@simplemicro.com. NO returns, of any type, will be accepted without an RMA number. Please have the following information completed before sending the RMA Request Form: Customer name and number, Order/Invoice number, serial number of the product and the nature of the problem. An RMA number is valid for 10 days. Returned products sent without an RMA number visible from the outside of the shipping box, or with an RMA number more than 10 days will be refused. The customer is responsible for all-shipping charges and risk of loss on all return shipments. SIMPLEMICRO recommends the use of reputable carriers capable of providing proof of delivery as well as insuring your shipment.

Shipping damage and lost packages must be claimed to the shipping carrier at the time of delivery. All DOA products must be reported to SIMPLEMICRO technical center within 24 hours. Only DOA product can be returned for credit .Product(s) returned without defects will be subject to a fee of $20.00 per item plus $20.00 handling fee and freight. If some items are missing, please report SIMPLEMICRO within 24 hours. All defective products will be accepted by SIMPLEMICRO for exchange or repair, at SIMPLE Micro's discretion within 30 days from the invoice date.
All returns for credit are subject to a 20% restocking fee based on current price, and must be completed within 30 days of the date of invoice, Thereafter, all sales are final.. Product being returned must be in the original Packaging and in new and unused condition.
* All products to be returned must be returned within 30 days from the invoice date, 100% complete, in resalable condition, and must include original packing material, manuals, blank warranty cards and other accessories provided by the manufacturer. All service part sales are final and non returnable. Products that are returned for replacement or refund, non-defective, opened returns are subject to a 20% restocking fee and all non-products related fees (shipping, handling, insurance and transaction) are non-refundable.
* Any special order item may only be returned for replacement and not for refund.
* Return authorization must be received within 10 business days from the date of the RMA or the return will be refused.
* We will not be held responsible for you ordering the wrong product(s) all refusals will be credited minus the freight charges.
* Only DOA/Defective products are allowed for return for replacement or credit.
* All returns must be shipped freight prepaid. Any return sent back freight collect will be refused.
* Any items found non-defective or opened software can only be returned for replacement.
* All products sold (unless otherwise stated) are sold with full manufacturer warranty; the warranty for each product varies on the manufacturer.
* For items returned for credit, this should be done within 7 days on Invoice. All items must be in "as new" condition in original packing and with all warranty cards, manuals, CD's, disks and accessories. Items not in original box or parts missing will denied credit and the same item will be returned.
* Shipping fees will not be refunded if shipment is refused at time of delivery.
* Refunds on purchases made with a credit card will be posted to the original credit card used at the time of sale.
Legal Disclaimer
Seller hereby expressly disclaims all warranties either expressed or implied warranty of merchantability or fitness for a particular purpose. This disclaimer by the seller in no way affects the terms of the manufacturer's warranty if any. Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to purchaser. If goods herein being purchased are being purchased for purposes of export, purchaser must obtain from the Federal Government certain export documentation before shipping to a foreign country. In addition, manufacturers' warranties for exported goods may vary or even be null and void. If you have questions, please inquire. Any and all liability is only for the products purchased.
RMA Procedure
* In order to obtain a RMA #, we will accept RMA requests through Email only.
* No RMA request will be accepted through phone or fax.
* If you receive a defective product, please send an email to rmat@simplemicro.com with the product name, nature of the problem and invoice number.
* Please allow 48 hours to respond.
* RMA status inquiry and questions, contact service@simplemicro.com
* SIMPLEMICRO.com will not accept any return without an RMA number.
* RMA numbers are valid for 10 days only, after a 10 day period a new RMA number must be requested.
* For all returns, the customer prepays shipping. Freight collect shipments will not be accepted.
* Returns can be sent via UPS, FedEx, or any courier that uses a tracking system.
* Please allow 2-4 weeks for RMA service and Credit.

Sales Tax

We do not charge sales tax except for New Jersey shipping addresses; The current tax rate is 7.00%.

NJ resellers and tax-exempted identities who wish not to be charged with sales tax should contact us before placing an order. Our representatives will be happy to walk you through the process. For your convenience, your information will be kept on file for future purchases.

Shipping Service

All orders placed before 3pm EST will be shipped the same business day. Orders placed over the weekend will be shipped Monday. Business day does not include Saturday, Sunday and national holidays.
Our corporate offices are located in New Jersey, and we may ship some items from different warehouses within the United States.
We use UPS and DHL as our carriers. All orders are shipped F.O.B. destination once credit is approved.
In an effort to deliver all products in a timely manner, your order may be fulfilled in multiple shipments. If any item in your order is delayed or back-ordered, we will ship the items when they become available. You may receive more than one shipment for each order.
Please Note: All orders are shipped Monday through Friday only during regular business hours. Overnight air shipping is not available for Sunday delivery. Delivery time is from point of order fulfillment, not order placement.
The standard shipping method is ground shipping, which usually takes 3-6 business days.
We do not ship to P.O. Boxes

Please Note: At this time we are unable to ship to APO/FPO or P.O. Box addresses.

Two-to-seven non-holiday business days for delivery. (weekends and holidays not included)

Second Day Air:
Two non-holiday business days for delivery. (weekends and holidays not included)

Next Day Air:
Next business day (weekends and holidays not included)

Saturday Delivery:
For orders placed on a Friday for Saturday delivery (not available in all areas) Orders must be received by 2pm EST for a Saturday delivery order.
